Although we all know that Kim Kardashian is carrying Kanye West's baby, but by law Kanye West ISN'T THE FATHER. By law, Kris Humphries, who is still married to Kim Kardashian, is the father of her unborn child.According to Hollywood Life, Kim isn't ready to "fully embrace" her pregnancy with Kanye West because of the fact that she's still married to Humphries. By law it's presumed that Humphries is the father of the unborn child. And furthermore, Humphries could attempt to claim custody.Due to Kris' basketball schedule, both would have to wait until June for a divorce court date, which is around the time Kim is suppose to give birth. Most likely, Kim will give birth to Kanye's child while still married to Kris.It appears that both Kanye and Kim know the legal matter regarding their unborn child, as Kanye is desperate to get Kris out of Kim's life."The state has vested interest in not having bastards, so there is a presumption that he (Kris) is the father," legal expect Raoul Felder explained. Kim would then need to show proof that indeed Kanye impregnated Kim, which is said to have happen back in October when the two were overseas.Hopefully the fact that Kim filed for divorce from Kris (before getting pregnant by Kanye) will end any and all doubts about who really is the father of Kim's baby.
