Baseball and Drugs - Good Read - Talks pending on baseball drug agreement

Is the MLB it's own sovereign nation and government? Look at these excerpts below. My comments are in brackets.

Although baseball's drug agreement says players who file grievances following a first positive drug test receive automatic stays, the text doesn't address suspensions stemming from non-analytical positives.

[Baseball players can file a grievance and get absolved for a first offense? Could you imagine if the "common people" in the USA could do this? It would be laughed out of court. 'Your honor, I would like to file a grievance and have no record, just probation please'. Yeah right!]

Mitchell, a Boston Red Sox director, recommended commissioner Bud Selig not punish players implicated in his report "except in those cases where he determines that the conduct is so serious that discipline is necessary to maintain the integrity of the game."

[The MLB is as or more powerful than our the U.S. judicial system? They can choose who they punish for doing drugs, wow.]

Commissioner Bud Selig adopted most of the recommendations made by former Senate majority leader George Mitchell but could not address those that were subject to collective bargaining.

[Another great example of how the MLB is exempt from U.S. law and government. He ADOPTED MOST of the recommendations? The MLB can pick and choose how they govern drug use - isn't that what the Feds like the FBI and DEA do?]

So, seriously, does anyone agree with the commentary written in the brackets after the article excerpts?

I think it is amazing how they seem to be able to almost govern themselves and "punish" as they see fit, without any interference, as if they were their own country and government.

They almost seem to have the same rights as ambassadors and diplomats which have "diplomatic immunity" in the U.S.

It seems like the recent trials were a dog and pony show and will be forgotten. Who wants in on the MLB government, lol?

The reason why Mitchell recommended that Selig not punish those named in the report was that many who were named were accused of using the performance enhancing drugs during a period of time where there was no MLB drug policy in place. To continue with your comparison to the US Judicial System, it would be like enacting prohibition and then retroactively prosecuting anyone who has ever used alcohol.

There are also some policies that Selig cannot change unilaterally. The Collective Bargaining Agreement would need to be modified in order for those policies to be enacted. For that you need cooperation from the Players Union.

Given, there have been a few decades of MLB Execs, team owners, and others turning a blind eye to a growing problem, especially when some of those accused were drawing in bus loads of fans. Many of them have now realized what needs to be done and are working toward it. This initial MLB drug testing policy and punishment system was rather toothless. Recent revisions have become stronger. Rome wasn't built in a day.

even though hes never gonna admit it, selig coulda stopped this whole thing. if he woulda taken the blame on behalf of him and the owners for enabling such a widespread use of steroids, i believe ppl would have alot more resolve about steps toward cleaning up the game.

and its not just the mlb that thinks its exempt from the government. the commissioners from the four major sports have all done things that have pissed me off. for example, i really hated it when roger goodell suspended pacman jones before there was any legal ruling on his incident. i know he probably deserved it, but still, you cant just suspend someone cause you think they did something but have no definitive proof. these guys really do think that they are the top of the food chain. even heads of sport-like organizations like dana white (UFC) and vince mcmahon (WWE) are total control freaks. thats why i was really happy when congress stepped in about the whole spygate thing at the end of the year. i dont know, i guess theres no such thing as a sports organization thats run fairly, the fact is that all these ppl mentioned above (except gary bettman) have done great things for improving the business of their respective sports
