It hasn’t been in play since 2005, but the new CBA deal now contains something called an “amnesty clause.”

This clause gives the organization to waive one “bad contract” if it meets the requirements. Once the player is released, the salary of that player does not count against the cap, even though the organization is still required to pay the player the given amount of money on his contract.

Some believed that Elton Brand could be a victim of this, yet head coach Doug Collins has been adamant in retaining him because of his improved play last season.

With that said, the most likely victim of the amnesty clause on the 76ers’ roster is wingman Andres Nocioni. The Argentine veteran is owed $6.7 million this season, which is a lot for a player that averaged 6.1 PPG and 3.1 RPG in the 2010-11 season. And as Marc Stein and Chad Ford of ESPN.com point out, “Philly could try to buy Nocioni out instead, since the Argentine has expressed interest in finishing his career back home or in Europe.”

Either way, the chances of Nocioni returning to Philadelphia are very slim. Right now, the Sixers don’t have much cap space to work with; yet with two to three spots left on the roster to fill out, the Sixers would create a decent amount of cap space with the decision to waive Nocioni and they would be able to pick up some much-needed quality bench bodies.

The amnesty clause was last issued back in 2005, commonly being referred to as the “Allan Houston Rule.” Originally, the New York Knicks were believed to be sold on the idea of using the amnesty clause on their injury-plagued guard, Allan Houston. However, the Knicks opted not to use the clause on Houston.

The first player to be affected by the clause in 2005 was Portland’s Derek Anderson, who was owed $19 million over two seasons despite averaging 9.2 PPG. The Knicks used to rule on Jerome Williams (approximately $40 million), Dallas used it on Michael Finley ($51.8 million over 3 seasons), and the 76ers used the clause on Aaron McKie.
