Brett Favre's lawyer views case against McAfee as 'slam dunk'

A lawyer for retired quarterback Brett Favre certainly isn't lacking confidence when it comes to his client's the much-publicized lawsuit filed against media personality Pat McAfee.

"We think it’s a slam dunk," attorney Eric Herschmann said during an appearance on 'The Daily Wire'’s "Crain & Company" program. "(Fox Sports') Shannon Sharpe — since he’s been sued — has been quiet. Pat McAfee keeps talking about it and in all of my years as an attorney and being a prosecutor previously, I don’t think I’ve ever seen a defendant build a case against themselves." 

It was reported in early February that Favre had filed defamation lawsuits against McAfee, Sharpe and Mississippi state auditor Shad White over statements made about Favre's alleged involvement in a welfare scandal and the construction of a volleyball complex at the University of Southern Mississippi. Favre played football at the university, and his daughter featured for the school's volleyball program. 

McAfee later vowed during an episode of his "The Pat McAfee Show" that he would see Favre in court. McAfee also said at that time he was "excited to see how it goes" and that he needed lawyers. 

On Feb. 27, McAfee confirmed that he had been served by Favre. 

Herschmann said that McAfee's defense that he used the word "allegedly" while making comments about Favre isn't valid because the Favre camp insists McAfee "didn’t throw in the word." Herschmann added that "if (McAfee) did any research or had a lawyer looking," he'd realize "that’s not really a defense." 

One legal expert explained last month that he didn't love Favre's chances of winning in court. Nevertheless, the BSM story notes that Herschmann indicated attorneys could go after "other pundits" depending on what they said about Favre. 

Favre has denied any wrongdoing in the matter and has not been charged with a crime.
