Yankees Fan Injured During Game Files $10 Million Lawsuit

The woman was sitting behind protective netting, though it allegedly did nothing to stop the bat from flying through and injuring her.

“It is the one location where the law has long required a stadium operator to provide adequate protective screening,” according to the suit.

The lawsuit alleges that the protective netting was “significantly lower” than adjacent sections, leaving an “unprotected opening.”

Duluc allegedly suffered significant and severe injuries. The bat struck her “with such force that it knocked her from her seat and violently threw her to the ground, causing her to sustain severe and permanent injuries," the lawsuit claims.

The Yankees fan claims to have suffered traumatic brain injury, concussion, severe light sensitivity and permanent damage to her neck and hands — leaving her completely “unable to return to her professional duties," according to the New York Post.

However, two weeks after she was hit in the head at the game, she appeared on PIX 11 in New York. She appeared on camera under studio lighting to discuss a recent event sponsored by her company at Fordham University. Her lawyer claims that her TV appearance does not contradict her lawsuit "at all."

“Ms. Duluc continues to suffer significant residual deficits from her traumatic brain injury, including persistent headaches, sensitivity to light, balance issues, and other cognitive impairments,” said Jon L. Norinsberg.

“A brief television appearance does not mean she has recovered or is capable of performing her professional duties on a sustained basis,

The Yankees have not commented on the lawsuit.

New York is 64-51 on the season.
