Attorneys fighting to keep Henry Ruggs' medical records from prosecutors

Attorneys for former Las Vegas Raiders wide receiver Henry Ruggs III are working to keep his medical records from prosecutors in the case involving Ruggs driving under the influence in a car crash that killed a 23-year-old woman last week, ESPN's Paul Gutierrez reported Wednesday.

Ruggs, 22, was charged Wednesday with four felonies and one misdemeanor for his role in the crash.

Lawyers David Chesnoff and Richard Schonfeld cited state privacy laws as they attempt to block access to Ruggs' medical records. A hearing has been set for Dec. 8 to decide whether or not the records will be blocked, Gutierrez said.

"I have been doing this for 40 years, and I can tell each and every one of you that I have had multiple experiences where the facts that were presented at the outset of the case turned out not to be the facts," Chesnoff said. "So that's why I keep saying, 'Please don't prejudge, let us do the work in the courtroom.' The state, the prosecutor will do theirs, and that's when the facts will be determined."

Ruggs allegedly was driving 156 miles per hour with a blood alcohol level more than twice the legal limit when his Corvette rear-ended Tina Tintor's RAV4 and caused it to burst into flames, killing her and her dog. The misdemeanor charge stems from Ruggs having a firearm in his possession while under the influence of alcohol. If convicted, Ruggs could face anywhere from two to 50 years in prison.

The Raiders released Ruggs on Nov. 2 within hours of learning of the crash and Ruggs' subsequent arrest.

Ruggs did not appear in court on Wednesday. Per ABC News, he is currently under house arrest and is under strict conditions while the proceedings take place.
