23XI Racing’s bold antitrust lawsuit against NASCAR has received some shocking rulings in the past couple of days. Front Row Motorsports, who joined 23XI after the lawsuit was formally filed, is also facing a massive threat in terms of its spot in the NASCAR garage. According to the court’s latest ruling, 23XI-FRM could lose its charter status within weeks. However, Bubba Wallace is unfazed by these updates as he insists that his focus lies on racing on the track and not the politics.
In the previous week, the United States Court of Appeals for the Fourth Circuit denied 23XI and FRM’s request for the matter to be looked into by all the judges of a court (en banc). The most recent update on the case by the three-judge panel is that the previous injunction safeguarding the teams of their charter status is now upheld. As such, both 23XI and FRM now risk a loss of charter status as early as the Sonoma or Dover race week.
Bubba Wallace, who has been racing with 23XI since the 2020 season, was questioned regarding his thoughts on the legal battle that his team is going through. While 23XI’s loss of charter could pose serious implications for Wallace and his seat with the team, he isn’t much concerned. The 31-year-old asserted that he did not follow the latest updates of the case.
Bubba Wallace pointed out that he was aware of the bottom line of the case and what it could mean if the team lost the lawsuit. The #23 driver insists that he has opportunities with him as he will keep showing up and scoring good results. The 31-year-old aims to keep racing until 23XI has to shut its doors after incurring massive financial losses following the open charter status. Regardless, he emphasized that he wishes to have fun no matter what happens in the end.

Denny Hamlin, the part-owner of 23XI alongside Michael Jordan, shared his opinion on the matter, which was similar to Bubba Wallace’s. The 44-year-old wasn’t too surprised when the court ruled in NASCAR’s favor and put 23XI at a disadvantage. Speaking on potentially losing the charter status and running as an open team, Hamlin asserted that he wasn’t affected by this, and his intentions with the lawsuit remained the same.
Denny Hamlin pointed out that the court’s latest ruling on the antitrust lawsuit was just a ‘very small part’ of the entire litigation. While 23XI runs the massive risk of losing its charter status alongside FRM, Hamlin insisted that he wasn’t deterred at all by the massive loss in the case. On top of this, the 44-year-old reassured that Michael Jordan, too, was very confident in the case despite the recent losses against NASCAR.
