The battle between the Wisconsin Badgers, Nyzier Fourqurean, and the NCAA has been reignited following a crucial decision.
Previously, defensive back Nyzier Fourqurean filed a preliminary injunction in response to an NCAA ruling that granted junior college transfers additionally Division I eligibility, but not Division II or Division III transfers. The original decision from the NCAA was handed down in response to Vanderbilt quarterback Diego Pavia requesting an additional year of eligibility for his season spent at the junior college level.
The NCAA responded by granting a blanket eligibility rule regarding junior college players, giving all players including Pavia the additional eligibility. Fourqurean, who spent time at Division II Grand Valley State, filed the preliminary junction to allow himself to play during the upcoming season despite exhausting his eligibility.
However, things quickly changed for Fourqurean and the Wisconsin Badgers after the defensive back saw his preliminary injunction reversed. The court of appeals ruled that the defensive back failed to fully express how his claim impacts the rest of college football, and stated that his claim depends “solely on himself not participating” during the upcoming season.
Wisconsin took a massive shot to the defensive once Fourqurean lost his additional year and now will not go down without a fight. The Badgers have filed an appeal in an effort to return the defensive back to the team for the upcoming season.
Wisconsin currently would be without Fourqurean at a very late point in the off-season as the transfer portal has closed and rosters have essentially been finalized. The Badgers need someone internally to step-up, which could be a challenge in one of the youngest rooms in Madison. Ricardo Hallman, D’Yoni Hill, and Geimere Latimer are the sole upperclassmen corner backs on the roster.
Without Fourqurean, the Wisconsin Badgers will need to rely upon a young defensive back proving himself. Cairo Skanes, Jaimier Scott, and Omilio Agard are early options that could take over for Fourqurean during the upcoming season should the Badgers new appeal fail to produce any results.
The chances of the appeal actually working out in favor of Wisconsin seems very slim as the Badgers are hammering home a singular approach. When asked about the situation, coach Luke Fickell stated he does not want to “change the landscape of college football” but hopes the NCAA can “change a kid’s life” with a decision.
Previously, the NCAA ruled in favor of Pavia due to the fact that the claim made by the quarterback was an issue that surrounded all of college football. During the reversal of the preliminary injunction filed by Fourqurean, the NCAA ruled that the claim of the defensive back did not present an issue that affects the rest of college football. Continuing to fight for just Fourqurean is an interesting approach on behalf of the Wisconsin Badgers, but could pay off in the end if the defensive back is able to return to play.
