Tiger Woods' Sun Day Red Brand Is Being Sued By Rival Company

Another company has sued Tiger Woods' Sun Day Red apparel line over a branding dispute.

Last September, Tigeraire claimed that Sun Day Red “unlawfully hijacked” its logo, which also features a leaping tiger. The lawsuit remains in litigation.

Puma also filed a notice of opposition against Sun Day Red's logo last week. The German sneaker and apparel company wants to prevent the new TaylorMade-owned brand from using its proposed insignia.

"Due to the confusing similarity of the marks and the identical, legally identical, or closely related nature of the goods and services of the parties, consumer confusion is likely between the Challenged Marks and the Leaping Cat logo," Puma said in the filing, per CNBC.

In response to the latest litigation, TaylorMade told CNBC that they "feel very confident in our trademarks and logos." However, trademark attorney Josh Gerben said Sun Day Red faces a "significant" obstacle from Puma.

"This is a real fight," Gerben, who is not involved in the lawsuit, told CNBC. "Any time you have open litigation you can lose. I think Puma has a legitimate case."

Woods announced the creation of Sun Day Red in February after ending a 27-year partnership with Nike. The company's website promotes clothing "for those who lead active lifestyles and seek elevated attire that can be worn on the course, at the gym, in the office, and everywhere their busy lives take them."

"This brand stands alone," TaylorMade CEO David Abeles said on Sun Day Red's launch day. "…This brand will have its own identity. It will have its own identity when we launch it tonight. It will have its own identity 20 years from now."

Woods' company continues to fight a legal battle against Tigeraire, which designs helmets for youth, college, and professional athletes. In September, Sun Day Red filed a countersuit accusing the smaller entity of trying to "extract an unwarranted financial windfall from a larger and more successful brand."
