Denny Hamlin Breaks Silence on 23XI-FRM’s New Restraining Order Filing Against NASCAR

23XI Racing and FRM have taken some massive hits in their legal lawsuit against NASCAR regarding the charter system for the teams. The United States Court of Appeals for the Fourth Circuit recently declined the team’s appeal for an en banc (hearing of the case in front of all judges of the court).

This meant that 23XI-FRM now runs a massive risk of losing its charter status, as early as this week. Regardless of seemingly losing the battle, Denny Hamlin revealed that the teams have once again filed a new preliminary injunction, but with a massive twist this time.

23XI’s Co-owner Denny Hamlin has been uninterested with the Court’s ruling over the matter as he hopes for the team to continue racing regardless of their charter status. Hamlin had asserted that he wasn’t deterred even if the team lost their charter. Now, the JGR veteran has revealed that 23XI and FRM filed yet another preliminary injunction alongside a unforeseen restraining order against NASCAR as a whole.

Denny Hamlin revealed the latest twist in the 23XI-FRM vs NASCAR lawsuit saga. The 44-year-old pointed out that the team’s basis for filing another injunction was because of a series of recent and new monopolistic acts by NASCAR. Hamlin claimed that the sport carried out these acts and swept them under the rug, keeping them obscure, as a majority of the events were redacted and not even found out by the people.

We filed a new preliminary injunction, and we also filed a restraining order against NASCAR. The basis for the two are through discovery, we obviously revealed — and so much of this is redacted — a monopolistic series of acts that have occurred.

Denny Hamlin said on the Actions Detrimental podcast.

Denny Hamlin further warned NASCAR that the teams need not fear losing their charter status already. A formal trial of the legal dispute is already scheduled for 1st December as the 44-year-old warns NASCAR not to disturb the 23XI or FRM’s peace until then. Hamlin explained that the teams were looking to not lose their charter status at all, and even if they lost the charter for now, but won the case in December, what would the sport do then to give the lost charters back?

We believe the status quo of us having our charters should not be disturbed until this is resolved on Dec. 1 in the courtroom. The reason being… we’re seeking for them to not be able to take and then sell our charters because if we prevail in December, how do you get that back? You can’t.

Denny Hamlin added.

NASCAR has been provided time until 5 P.M. ET on Wednesday of this week to submit its official response to the matter. While Denny Hamlin and Co. wanted the sport to respond as soon as Tuesday evening, the judge has provided some relief to the executives of stock-car racing.

However, time is of the essence as 23XI and FRM are set to lose their charter status by Wednesday as the newly filed injunction could put forth some new twists.

Denny Hamlin wants to field cars with 23XI ‘regardless of being chartered or unchartered’

23XI Racing Star Bubba Wallace had already issued an uninterested statement on the team’s legal dispute with NASCAR. The 31-year-old asserted that he would focus on racing and performance and not the petty politics between the two entities.

Now, Denny Hamlin joins the same boat as he notes that he is unfazed by the fate of the team. The JGR Veteran wants to field cars even if the team loses its charter status in the near future.

Denny Hamlin reassured that 23XI would race as they are committed to racing in the 2025 season. The 44-year-old added that no matter the team’s status, being chartered or unchartered, 23XI wouldn’t back down. However, Hamlin pointed out that there was legible evidence that pushed the two teams to file yet another injunction. As far as the playoffs were concerned, the JGR star insisted that the team’s vision and goals remained unchanged.

We’re going to race, We’ve always said we’re committed to racing this season, whether it be chartered or uncharted. But certainly, there’s been some evidence that has been revealed that warrants this preliminary injunction. … Everything would be the same there as far as racing for the playoffs.

The 2025 season has been very exciting and enticing, thanks to these unforeseen situations. Even though 23XI and FRM have a massive risk at hand, they aren’t backing down from their case, which strengthens their ideology behind the legal dispute. Now, time will tell if NASCAR responds to the restraining order and caves into the team’s demands up until December.
