The term "Evil Empire" that started out as an insult about the New York Yankees — by Boston Red Sox president Larry Lucchino in 2002 — has now been ruled by judges to belong to the intended target.
Trademark judges ruled an entrepreneur cannot register the phrase "Baseballs Evil Empire," used to describe the Bronx Bombers, after Major League Baseball objected to the trademark application on behalf of the Yankees, saying the team had claims to the phrase.
"The record shows that there is only one EVIL EMPIRE in baseball and it is the New York Yankees," the judges wrote in their decision earlier this month, via the New York Daily News.
A company registered as Evil Enterprises Inc. sought exclusive rights to sell clothing like hats, jackets, t-shirts and pants branded with the "Baseballs Evil Empire" slogan.
The business targeted customers looking for Yankees merchandise by claiming: "If you are passionate about the New York Yankees then you have come to the right place."
The term "Evil Empire" was widely used by fans and media to describe the Yankees stockpiling of superstars and dominance of the sport.
Lawyers for MLB used hundreds of news stories that used the term "evil empire" to talk about the Yankees. The team even uses the "Star Wars" soundtrack at Yankee Stadium games.
Lucchino coined the phrase after the Yankees had acquired sought after Cuban pitcher Joe Contreras. At the time a sarcastic Lucchino said, "The evil empire extends its tentacles even into Latin America."
Evil Enterprises Inc. applied for the trademark in 2008, but the judges said allowing the company to use the phrase would cause confusion to those who mistakenly think the merchandise was endorsed by the Yankees.
The Yankees declined to comment on the case. But is that Darth Vader's heavy breathing I hear coming from Yankee Stadium?

But father time has never lost a battle and Jeter will eventually need to hang up the cleats...
Even judges believe that the Yankees are truly baseball’s only evil empire, and they have the documents to prove it.
According to the Wall Street Journal, a private entrepreneur, Evil Enterprises Inc., has been trying to trademark the phrase “Baseballs Evil Empire,” since 2008, but a panel of trademark judges in Washington, D.C., denied the request earlier this month.

The name “Evil Empire” may have started as a derogatory term for the New York Yankees, but it is now apparently one that they take pride in and enjoy profiting from. It’s a good thing his new teammates have a good sense of humor.
Kevin Youkilis, who recently told the media that he’ll “always be a Red Sox,” entered camp earlier this month with his new Yankee teammates. While there was some ribbing going on, Youk told the YES Network that he and his fellow Yanks were able to laugh off his comments and any other “non-stories” that came...
The New York Yankees are so evil that they literally sued for the right to call themselves "The Evil Empire".
In all of sports, it's common that fans of a team view their own club as the good guys and their rivals as the bad guys. For any Red Sox fan, the New York Yankees have always been seen as the 'bad guys' and also even dubbed the 'Evil Empire'. Well, after 27 World Series victories the Yankees are widely considered one of the most hated teams in the history...
