Aaron Hernandez's defense team criticized prosecutors for filing a motion to have Judge E. Susan Garsh step aside in the murder case, The Boston Globe reports.
"But by filing the motion and publicly suggesting that [Garsh] harbors ill will toward the prosecution, perhaps the Commonwealth hoped to intimidate the Court from ruling in [Hernandez's] favor on any future motions in this case," the lawyers for the former Patriots' star wrote in a court filing.
"If that [was] the District Attorney's purpose in filing this motion, shame on him," the defense team added.
Gregg Miliote, a spokesman for District Attorney C. Samuel Sutter, said in response that Hernandez's lawyers were attempting to "curry favor with the judge." Miliote also said that prosecutors filed a similar motion two years ago in a case involving the slaying of a child that Garsh presided over.
"Judge Garsh chose not to rule on that motion and instead referred the case to another judge," Miliote said in an e-mail. "The filing of the recusal motion is completely consistent with what we did two years ago. This motion should have been addressed at that time, and now it finally will be heard."
A hearing on the recusal motion is set for Monday.

This Sunday the New England Patriots (5-1) travel to New Jersey to take on the New York Jets (3-3). The game will be shown at 1 PM (EST) on CBS.
This has been a weird week. Last Sunday’s game against the Saints was simultaneously an instant classic, one of the greatest clutch moments in Tom Brady’s career, a return to form for Stevan Ridley, and a huge win over a great team,...
Soon after Patriots tight end Rob Gronkowski’s agent Drew Rosenhaus announced Gronk is medically cleared to play, this Youtube video appeared, sort of announcing his return, but more importantly to sell his energy drink… SuperStar Rob Gronkowski gave BODYARMOR SuperDrink, the beverage brand he is a partner/investor in, the opportunity to document his recovery. What resulted...
Tom Brady has a smile that goes from ear to ear, and I don’t blame him. Good luck New York Jets, your battle just got a lot harder. Rob Gronkowski is the best tight end in the game when healthy. In the past few years he has been banged up quite a bit, suffering some […]
Imagine Bill Belichick showing up Sunday wearing a cowboy hat and boots. Then cracking jokes in his post-game press conference.
You don't see that stuff with Belichick or any other coach these days. That's why we should all bow our heads, place an imaginary Stetson over our hearts and honor the memory of Bum Phillips.
"Beloved Bum has been ill a long, long time,"...
EAST RUTHERFORD, N.J. — The Patriots will be without their top cornerback on Sunday.
New England ruled Aqib Talib and safety Tavon Wilson out against the Jets. Talib is dealing with a hip injury, suffered last Sunday against the Saints. Wilson has a hamstring injury. Neither player made the trip to New York.
Talib missed practice on Wednesday and Thursday. He was back on the practice...
Rob Gronkowski is back.
The injury-prone New England tight end has officially been cleared to play by team doctors, which caps off two months of grueling rehab for Gronkowski. To celebrate Gronk’s return, “Super Drink” retailer BodyArmor released a commercial showing never-before-seen footage of the tight end going through his rehab routines and talking about how hard it was...
Jerod Mayo is done for the season. How big of a loss is this for the Patriots both in the short-term and the long-term if he ultimately doesn't come back?
Raj: Honestly, I can't say anything except for the fact that this really sucks. With Mayo out, both defensive captains (the other being Wilfork) are done for the year. And this comes right when the Patriots defense...
Season-ending injuries to Vince Wilfork and Jerod Mayo briefly left the Patriots without a defensive captain. The team has now announced that Rob Ninkovich and Devin McCourty will serve as captains for the rest of the season.
With captains Vince Wilfork & Jerod Mayo on IR, Devin McCourty & Rob Ninkovich have been named defensive captains.

FOXBORO, Mass. — With Jerod Mayo lost for the season, it’s another case of “next man up” for the Patriots at linebacker.
Jamie Collins has received the most snaps as a reserve linebacker, though many have assumed fourth-year linebacker Dane Fletcher will get a heavier workload Since he’s only played 12 snaps on defense this season, Fletcher said he doesn’t know how...

The murmurs about Rob Gronkowski's playing status have quieted down quite a bit this week, but his agent Drew Rosenhaus wanted to clear the air on all the supposed controversy.
Rosenhaus joined the Joe Rose Show as he does weekly on WQAM in Miami on Thursday to discuss all things NFL. As has become a recurring theme this season, Rosenhaus was asked about Gronkowski and all the...
Mike Petraglia of WEEI.com reports that New England Patriots shutdown cornerback, Aqib Talib, will miss Sunday’s game against the New York Jets while Mike Reiss via twitter reports tight end Rob Gronkowski is “cleared” to play.
Talib suffered a hip flexor strain last Sunday against the New Orleans Saints and has not practiced all week.
The injury to Talib is a rotten cherry...
New England cornerback Aqib Talib (hip injury) returned to practice on Friday after missing the first two sessions this week.Fantasy Spin:Talib isn't likely to be 100 percent by kickouff and the Pats may try to squeeze past the Jets without him. Given Bill Belichick's communication with the media, we probably won't know for sure until inactives are announced Sunday morning.

Gronkowski’s agent, Drew Rosenhaus said via text that his client is ready to go. “Rob Gronkowski has now been cleared by all his doctors to play Sunday in the Jets game,” agent Drew […]
The New York Jets held Tom Brady to just 185 passing yard in Week 2, but ultimately unraveled down the stretch en route to a 13-10 in Foxborough. If Rex Ryan and company hope to pull the upset on the return leg of the AFC East matchup, the Jets will need to get creative defensively to keep Brady and the Patriots on their heels.
