“The federal mediator is simply trying to get the collective bargaining process to move more productively,” said Daniel E. Lazaroff, a professor at Loyola Law School and director of the Loyola Sports Law Institute. “Of course, if they reach an agreement, there won’t be a need for decertification, but it does not preclude that option at all if a mediator cannot facilitate a new collective bargaining agreement. … This is simply part of the collective bargaining process. If it fails, then we get to the legal options—union decertification, unfair labor practice charges, or antitrust suits.”
