“The federal mediator is simply trying to get the collective bargaining process to move more productively,” said Daniel E. Lazaroff, a professor at Loyola Law School and director of the Loyola Sports Law Institute. “Of course, if they reach an agreement, there won’t be a need for decertification, but it does not preclude that option at all if a mediator cannot facilitate a new collective bargaining agreement. … This is simply part of the collective bargaining process. If it fails, then we get to the legal options—union decertification, unfair labor practice charges, or antitrust suits.”

Lawton went on to say he thinks it is more about having a season at this point and there is interest on both sides.

Does the union threat of decertification threaten that? Probably.
