by A.J. PerezFree-agent offensive lineman Jamar Nesbit has sued the NFL for fraud and negligence in the way the league handled a positive test for a banned diuretic.
The lawsuit filed in U.S. District Court in New York on Wednesday alleges the league knew two years before Nesbit and other NFL players consumed Nikki Haskell's StarCaps that the product contained Bumetanide, but did not pass along the information to players. Nesbit, who was suspended for four games during the 2008 season, is seeking unspecified damages.
"Had Mr. Nesbit been advised by the finding of the test results commissioned by the NFL, namely that StarCaps contained the undisclosed ingredient Bumetanide, a banned substance under the policy, Mr. Nesbit would never have purchased, let alone taken, StarCaps," Brian Molloy, Nesbit's lawyer, wrote in the 24-page lawsuit.
