Cleveland Indians outfielder Austin Kearns is scheduled to have a pretrial hearing for charges relating to a DUI incident at 9:00 a.m. today, according to the Jessamine County District Court docket.

Kearns’ lawyers pled “not guilty” on their client’s behalf to one count of operating a motor vehicle under the influence of alcohol and another count of failing to maintain required automotive insurance at the arraignment hearing, March 10.

Kearns was pulled over early in the morning, Feb. 12, after the arresting officer saw him “flashing his headlights and weaving” in Jessamine, Kentucky, according to the police report. He then told the officer that he had “a couple bourbon and cokes” and asked if he could get a break because he was a baseball player, according to the officer.

Kearns did not inform the Indians of the incident until the story was published by the Jessamine Journal more than two weeks after his arrest.

Kearns will presumably be represented in absentia by his lawyers, as he is currently with the team in Kansas City.

If found guilty of both charges, Kearns would face a minimum of a $700 fine, a 30-day suspension of his driver’s license, and two days in prison. However, he could be facing up to $1,500 in fines, a complete revocation of his driver’s license, and 120 days jail time.
