According to Richard Sandomir of the New York Times, Fred Wilpon and Saul Katz are seeking to avoid a trial by jury against Irving Picard, the trustee appointed to recoup funds in the Bernie Madoff scandal. According to Sandomir, attorneys for Wilpon-Katz filed paperwork in Federal Court yesterday stating Picard “is not entitled to a jury trial” because the two remaining claims arise out of the bankruptcy code. The judge appointed to the case, Judge Jed Rakoff, dismissed nine of the 11 counts against Wilpon-Katz last month and limited their potential liability to $386 million in the case, although Picard has filed an appeal against Rakoff’s decision.
